In an unusual case, a court struck a super-strike, but nevertheless imposed a life sentence on my client, on the grounds that the “fact” of the strike remained. The situation was so unusual, no appellate court had ever considered the issue. After receiving the case on appeal, I asked the appellate court to reverse the life sentence because it was unauthorized by law. Today, the court issued an opinion, reversing the life sentence.
